Your privacy is very important to us and we have created this Privacy Policy (the “Policy”) to demonstrate our commitment to privacy and security.

This Policy describes how GiggedIn Pty Ltd (ABN 33 158 416 490) of c/- BlueChilli, Level 1, 125 York Street, Sydney, NSW, 2000 (“GiggedIn”, “we”, “us”) collects personal information, what we do with the information we collect, and the choices users have concerning the collection and use of such information.

This Policy applies to all personal information that we collect, use, disclose, store and handle, including information collected from users of our website located at http://www.giggedin.com, and all relevant subdomains (the “Website”) who use the Website to access our services (the "Services") and via our social media channels (including Facebook and Twitter (“Social Channels”)).

We request that you read this Policy carefully.


A Note to Users under 18 Years of Age

You must be 13 years of age or older to create an account and become a member of the Website. Please do not register if you are under 13 years of age. Certain events promoted on the Website can only be attended by persons who are 18 years of age and over. If you are under 18 years of age you should not purchase tickets to these events.


What kinds of information does GiggedIn collect?

The kinds of personal information we collect will depend on the purpose for which we are collecting it, but may include any or all of the following:

  1. your name;
  2. your contact details, such as your email address, postal address and phone number;
  3. your age or date of birth, to ensure you comply with Website use restrictions and other restrictions on the Services;
  4. your entertainment preferences; and
  5. your purchase history.

How GiggedIn Collects Your Personal Information

GiggedIn collects information in different ways from users when they access our Services, use our Website, and interact with us via our Social Channels. We generally collect personal information directly from you. If we collect your personal information from a third party we will ensure the third party has made you aware that your information will be passed on to us or will notify you that we have received your personal information as soon as is practicable after we have received it.

The information we collect includes, but is not limited to, information you provide:

  1. when you sign up for an account via the Website;
  2. when you make a pledge or purchase through the Website;
  3. when you participate in competitions; or
  4. when you participate in customer surveys we conduct.

You are not required to provide us with this information, but if you choose not to, you may not be able to register to use the Website, or use some or all of the Service functionality. For instance, you are not able to purchase tickets to events through the Website unless you have registered for an account.

In addition, we may use cookies to save your preferred Website settings and to collect data relating to your use of the Website and the Internet generally. This data may include your IP-address, browser type and version, and which Website pages you visit. A cookie is a small data file that is stored on your computer, which enables us to store information about your preferences and provide you with a personalised Website experience. These cookies do not enable third parties to access any of your personal information. However, advertisers and partners may also use their own cookies. We do not control use of these cookies and expressly disclaim responsibility for information collected through them.

We may also automatically collect information about the use of our site and store it in log files. This information may include IP-addresses, browser type, ISP, referring and exit pages, date/time stamps and clickstream data. This information is de-identified and does not identify individual users. This data is used to determine which parts of the Website are most popular, and other usage trends, and to gather demographic information, which may be shared with our third party partners in accordance with the terms of this Policy.

We may also use pixel tags, which are small graphics on each web page that tell us what parts of our website are being accessed and to measure the effectiveness of searches performed on our sites.


Transmission of Your Information Via the Internet

The transmission of information via the Internet is not completely secure. Any transmission is at your own risk.

If you create an account on the Website and nominate a password, you are responsible for keeping that password confidential.

You acknowledge that the Social Channels are owned and managed by third parties over which we do not exercise control. You should refer to the privacy policy of the relevant social channel for further information on their information handling procedures.

Secure web pages can be identified by their URL, which begins with https://. Usually, a secure “locked” icon will appear on your browser. All credit card transactions made via the Website are processed by a third party and are protected by Secured Sockets Layer (SSL) 256 bit encryption, as depicted by the “locked” icon in the browser window.

GiggedIn does not store user credit card information on GiggedIn servers.


Where your personal information is kept or transferred

The personal information we collect may be transferred to, and stored outside of, Australia. For instance, if any of our servers (or the servers of our third party hosting provider) are from time to time located outside of Australia or if one of our service providers or suppliers is located outside Australia, or if we share your personal information with a third party located outside of Australia (in accordance with the terms of this Policy).

While we will take all reasonable steps to protect your personal information, you acknowledge that any overseas recipient of your personal information may not be bound by Australian privacy laws and that your consent to our disclosure of your personal information to an overseas recipient pursuant to this Policy means that we will not be bound to take such steps as are reasonable to ensure that the overseas recipient does not breach Australian privacy laws.


How GiggedIn Uses Your Personal Information

GiggedIn generally uses personal information only for the purpose for which it is collected, or for related purposes. If you have given your consent, we may use your personal information to send you information and news about GiggedIn and our clients that use our Services. We may also provide you with information about products and services offered by our partners and sponsors. You can opt out of receiving these kinds of information at any time using the “Unsubscribe” facility provided in each email, by accessing the “Privacy Settings” in your account on the Website, or by contacting the GiggedIn Privacy Officer at the address set out below.

We use your personal information to provide a customised experience as you use the Website and our Services, and generally do not share this information with third parties. The personal information collected from members during the registration process is used to manage each member's account (such as for billing purposes). This information is not shared with third parties, unless specifically stated below

If you order services or products directly from GiggedIn we will use the personal information you provide only to process that order. Unless you have given us your express permission, we do not share this information with outside parties except to the extent necessary to complete that order.

Notwithstanding anything else set out in this Policy, we may disclose personal information to third parties if we have received your permission beforehand or in special circumstances, such as when we believe that such disclosure is required by law or other special cases described below.

We may also generate non-identifying and aggregate profiles from personal information members provide during registration (such as the total number of members, and their ages and postcodes, but not their names). As explained in more detail below, we may use this aggregated and non-identifying information to sell advertisements that appear on the Services.


Sharing and transferring your personal information

Subject to the other terms of this Policy we may share your information with the following:

  1. our related bodies corporate;
  2. third party service providers for the purposes of providing credit card processing, credit reporting, and other services necessary for us to provide the Services to you;
  3. co-promoters of events and competitions conducted via the Website or in connection with the Services; and
  4. third party partners who provide services or products on or through the Website,

in each case, on a worldwide basis.

We may share your personal information with our clients whose events you have purchased tickets for or otherwise expressed an interest in. These clients may use the personal information in accordance with the terms of this Policy, to provide you with updated information on relevant artists and events.

Where you enter or take part in a promotion that we hold in conjunction with or for or on behalf of a third party partner, we may share your personal information with that third party partner.

We may transfer, sell or assign any information, including personal information, to third parties in connection with the sale, merger, consolidation, change of control, transfer of substantial assets, reorganization or liquidation of GiggedIn, or part of it.

We may share with others, at our discretion, certain aggregate statistical data about purchases and the use of the Website and the Services, which data may include demographic data such as age range and or geographic location of groups of users. No personal information (such as names or addresses) will be identifiable from such de-identified information.

We may disclose personal information in special cases when we have reason to believe that disclosing it is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference (either intentionally or unintentionally) to the Website, Services or to GiggedIn.

We may disclose your personal information, or information regarding your use of the Website and the Services when we believe in good faith that the law requires us to do so, including: to law enforcement, or to satisfy any relevant laws, regulations, or governmental or legal requests for such information; to disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating our Terms Of Service, or other user policies; to operate the Services properly; or to protect GiggedIn and our members.

We will not share your personal information with third parties for the purposes of them marketing their goods and services to you unless you have specifically opted-in to receive marketing material from that third party.

Some products and services may be offered to users in conjunction with an affiliate, independent contractor seller or non-affiliated partner. To provide users some of these products and services, the partner may need to collect and maintain personal information. In these instances, you will be notified before any such data is collected or transferred and may decide not to use that particular service or feature.

We may take the information we receive from individuals responding to our Customer Surveys and combine (or aggregate) it with the responses of other customers we may have, to create broader, generic responses to the survey questions (such as gender, age, residence, hobbies, education, employment, industry sector, or other demographic information). We then use the aggregated information to improve the quality of our Services to you, and to develop new services and products. This aggregated, non-personally identifying information may be shared with third parties.

Please remember that any information you may disclose in any comments section or other public areas of the Website or Social Channels, becomes public information. You should exercise caution when deciding to disclose personal information in these public areas.


Accessing and Correcting Personal Information

If you wish to seek access to the personal information GiggedIn holds about you please make a request in writing to the GiggedIn Privacy Officer at the address set out below. You should provide some form of identification (eg. a photocopy of your driver’s licence or passport) so GiggedIn can verify you are the person to whom the information relates. You should also include details of how GiggedIn can contact you in case we need to discuss your request.

If you think that any of the personal information GiggedIn holds about you is inaccurate, out of date, incomplete, irrelevant, or misleading you can ask us to correct your personal information by sending a request to the GiggedIn Privacy Officer at the address set out below. If GiggedIn agrees that your personal information is inaccurate, out of date, incomplete, irrelevant or misleading, GiggedIn will correct it. If GiggedIn does not agree with your view we will provide you with reasons for our view, and will provide you with an opportunity to make a statement of your view and have it included with the relevant personal information.
